This is an alarming situation that threatens the balance of powers and system of checks and balances enshrined in the Constitution. President Trump's executive orders directing agencies to "pause" congressionally appropriated funds appear to violate the Impoundment Control Act and infringe on Congress's power of the purse. His blanket withholding of funds outside the statutory process serves not to temporarily delay, as permitted under the ICA, but to realign spending with his policy preferences, an unauthorized reason. This unilateral assertion of power over enacted funding inverts the proper separation of powers. The Constitution does not grant the president carte blanche authority to impound funds, and such overreach jeopardizes our democracy. Congress must robustly investigate this executive overreach, demand full transparency, and direct the release of any improperly withheld appropriations to uphold its Constitutional role as a co-equal branch of government and safeguard the system of checks and balances protecting against accumulation of unchecked executive power.
