Habeas Corpus Is Not a Partisan Issue The right to challenge unlawful detention has existed in Anglo-American law since the Magna Carta. It is embedded in Article I, Section 9 of the U.S. Constitution, which states that habeas corpus “shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.” No such circumstances currently exist. Suspension under any other pretense is unconstitutional and autocratic. Historical Precedent Warns Against Abuse Only three times in U.S. history has habeas corpus been suspended—during the Civil War, in Hawaii after Pearl Harbor, and briefly during Reconstruction.
