Today I’m writing to urge you to reject S.1671, introduced by Republican Senator Mike Lee, that seeks to revise the legal definition of obscenity in a way that could potentially impact video games, anime, and other forms of media.
This bill poses a risk to freedom of expression and could lead to censorship of artistic works deemed "obscene" under the new criteria. As a strong proponent of the First Amendment and artistic freedom, I urge you to reject this legislation.
There are already definitions of obscenity in the 1934 Communications Act.
However, the most serious redefinition that can threaten freedom of expression is:
“Strengthens the existing general prohibition on obscenity in the Communications Act by removing the “intent” requirement that only prohibits the transmission of obscenity for the purposes abusing, threatening, or harassing a person.”
So in essence, making anything loosely judged obscene definable as a threat!
Attempting to restrict creative content based on highly subjective moral standards is a slippery slope that threatens the principles of a free society.
What’s next? Statues, paintings expressive dance?
Video games and anime are also legitimate art forms enjoyed by millions, and they must not be subject to overly broad censorship laws.
Please stand up for constitutional rights and vote against S.1671.
